Terms and Conditions for Xenia’s

These Terms and Conditions (“Terms”) apply to your use of xenias.co.uk (the “Website”) and any catering, food supply, collection, and related services provided by Xenia’s (“we”, “us”, “our”).

By using the Website, requesting a quote, placing an order, or booking services, you agree to these Terms.

2. Services
We provide catering services and made-to-order food items. Service availability, menus, pricing, and lead times vary and are confirmed at the time of booking/order confirmation.
3. Quotes, Bookings, and Order Acceptance
1. Quotes are indicative until confirmed in writing (email, invoice, or payment link).
2. A booking/order is accepted only when we confirm it in writing and, where applicable, receive the required deposit or full payment.
3. We may decline an order at our discretion (e.g., capacity limits or insufficient notice). If we cannot fulfil an accepted order and you have paid, we will refund you in full.
4. Your Responsibilities
You must provide accurate details, including:
  • Collection date/time, guest count (where relevant), and an on-the-day contact number.

  • Dietary requirements and allergen information (see Section 9).

You are responsible for checking your confirmation details. Requested changes after confirmation may be refused and may incur additional costs.
5. Pricing and Payment
1. Prices are shown in GBP. Any VAT treatment (if applicable) will be stated on your invoice/checkout.
2. For catering bookings, we may require a deposit to secure the date, with the balance due by the deadline stated in writing.
3. For food orders, full payment is usually required at checkout or via payment link.
4. Payments may be processed by third-party providers. We do not store full card details.
6. Changes to Orders
Any changes (quantity, date/time, menu) must be requested as early as possible. Changes are subject to availability. Where changes create extra costs (ingredients, labour, late changes), we may charge the difference.
7. Collection Only for Cakes and Syrnyky
Cakes and syrnyky are available for collection only. We do not offer delivery for these items.
Collection time and location will be confirmed in writing. If you fail to collect at the agreed time, we may be unable to store the items safely due to food safety and quality requirements. In that case, the order may be treated as fulfilled and may not be refundable.
8. Cancellation and Refunds
Because many items are made to order and involve perishable ingredients:
Food orders (including cakes and syrnyky)
  • You may request cancellation up to the deadline stated in your confirmation.

  • Cancellations after that deadline may not be refundable (or may only be partially refundable) because ingredients and labour may already be committed.

Catering bookings
  • Cancellation terms (including any deposit treatment) will be stated in your booking confirmation/invoice. If not stated, deposits are generally non-refundable once planning and procurement have started.

Refund timing
  • Approved refunds are processed to the original payment method. Timing depends on the payment provider.

9. Allergens and Dietary Requirements
1. You must notify us of all dietary requirements and allergies at the time of enquiry/ordering.
2. We take reasonable precautions, but we cannot guarantee an allergen-free environment. Cross-contamination may occur.
3. Allergen information may rely on supplier data and recipes may change.
If you have severe allergies, contact us before ordering so we can confirm whether we can safely accommodate.
10. Food Safety, Storage, and Quality
Once your order is collected, you are responsible for appropriate storage and handling and for following any storage/reheating guidance we provide. We are not liable for issues caused by improper storage/handling after collection.
11. Complaints and Issues
If there is an issue, contact us as soon as possible and ideally within 24 hours of collection/event. Provide photos and details so we can investigate. If we accept fault, we may offer a replacement, partial refund, or credit depending on the situation.
12. Consumer Rights
If you are a consumer, UK consumer law applies. Where items are made to order or clearly personalised (e.g., custom cakes), “change of mind” cancellation rights may be limited once preparation has started. This does not affect your rights if something is faulty or not as described.
13. Limitation of Liability
Nothing in these Terms limits liability where unlawful (including death or personal injury caused by negligence, fraud, or fraudulent misrepresentation).
Subject to that:
  • We are not liable for indirect or consequential losses (loss of profit, business interruption, reputational loss).

  • Our total liability relating to an order/booking will not exceed the amount you paid for that order/booking.

14. Force Majeure
We are not responsible for failure or delay caused by events outside our reasonable control (e.g., severe weather, transport disruption, supplier failure, government restrictions). If fulfilment is impossible, we may cancel and refund amounts paid minus reasonable costs already incurred.
15. Website Use
You must not misuse the Website, attempt unauthorised access, or introduce malware. We may restrict access if we believe there is misuse.
16. Intellectual Property
All Website content (text, images, branding, logos) is owned by or licensed to Xenia’s. You may not copy or reuse it commercially without written permission.
17. Privacy
Personal data is handled according to our Privacy Policy.
18. Governing Law
These Terms are governed by the laws of England and Wales. Disputes are subject to the courts of England and Wales.
